1. Acceptance of Terms
By accessing this website, viewing online galleries, or placing print orders, you agree to these Terms and Conditions. If you do not agree, please refrain from using the site.
2. Client Gallery Access & Security
Private client galleries are accessed via unique links or password access provided directly to the client.
Clients are responsible for maintaining the confidentiality of their gallery access credentials. Unauthorized sharing of gallery links or passwords with third parties is strictly prohibited.
Galleries are hosted temporarily for viewing, proofing, and purchasing. The photographer reserves the right to archive or remove galleries after the specified expiration date provided at delivery.
3. Online Print Orders, Digital Downloads & Licensing
Digital Downloads: Digital files purchased or provided through the gallery are for personal, non-commercial use only (unless a commercial license is explicitly granted in writing).
Print Orders: Physical prints, canvases, and albums ordered through the online store are custom-produced. All print sales are final once an order has been submitted to the printing laboratory.
Color Matching & Quality: Due to differences in monitor calibrations, physical prints may vary slightly in color, brightness, or contrast compared to display screens. The photographer is not liable for print quality issues resulting from third-party printing labs if orders are placed outside the official client store.
4. Intellectual Property & Copyright
All images, text, and gallery media are the exclusive property of Megan Lynn Photography and protected by legal copyright.
Screenshots, unauthorized downloads, or altering images (including removing watermarks or applying filters) are strictly prohibited.
Personal print releases grant the right to print images for personal display but do not transfer copyright or ownership of the underlying image.
5. Booking & Service Agreements
Submitting a contact form or accessing a gallery does not constitute a booking commitment. Photography services, retainer fees, and session schedules are governed by a separate, signed photography contract.
6. Limitation of Liability
This website and online gallery store are provided on an "as is" basis. Megan Lynn Photography is not liable for technical gallery outages, server downtime, or loss of digital files beyond reasonable commercial control.
7. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the State of Montana, without regard to its conflict of law principles. Any legal action or dispute arising from the use of this website or online gallery store shall be filed exclusively in the state or federal courts located in Montana.
8. Changes to Terms
The photographer reserves the right to modify or update these terms at any time. Continued use of the website following any changes constitutes acceptance of the revised terms.
